In case you wandered what all the fuss is about when the media is reporting failures in proper disclosure in criminal cases, we thought we would give you a brief overview of what we believe the underlying problems to be
We first did an article about this in December last year, which you can read here. There is no point repeating everything that was said there, so we will just add that sadly, from all the media reports, the cases mentioned there were just the tip of the iceberg as many more cases reported.
The problem could of course stem from incompetence or corruption, but we would suggest it mostly stems from a lack of awareness and proper training.
